Tyranny - Madison

Madison defined Tyranny as:

“The accumulation of all powers, legislative, executive, and judiciary, in the same hands, whether of one, a few, or many, and whether hereditary, self appointed, or elective, may justly be pronounced the very definition of tyranny.” - James Madison

This follows the definition John Locke gave for tyranny.

The High Court ignores the Constitution and the 24th Amendment

This week the Supreme Court ratified Florida's poll tax on former felons, completely ignoring both the spirit and letter of the 24th Amendment!

The 24th Amendment clearly states:
“The right of citizens of the United States to vote in any primary or other election for President or Vice President, for electors for President or Vice President, or for Senator or Representative in Congress, shall not be denied or abridged by the United States or any State by reason of failure to pay any poll tax or other tax.”

Florida had barred felons who had served their time from voting. The state recently passed a constitional amendment stating:

“all terms of their sentence including parole or probation.”

Naturally the legislature passed a law “that required residents who have been convicted of a felony to pay all court costs, fees and fines before they can become eligible to vote.”

Since the court system doesn't seem to have any obligation to present a final bill to prisoners when they've done their time, this amounted to a poll tax, since there is no requirement that the courts not pile on additional fees (that amount to taxes) and in usual style, can turn a felon into a debt slave for years after they have done their time. Voting rights advocates sued, the first time on the grounds it discriminated against the poor, and the second time because such gratuitous fees and levies amount to a poll tax aimed at preventing the poor from voting. The district court noted these thingsf and also concluded:

“that because it could take years for the state to figure out how much residents with past convictions must pay to be eligible to vote, the law will discourage voters from registering at all, because they will be afraid that they will be charged with fraud if they make a mistake.”

So being mistaken about whether one has paid the taxes or not would lead to further incarceration!

Scotus Blog

This was appealed on 24th amendment grounds and also matters of justice. The appeal was denied with no grounds cited. Obviously to prevent the constitutional amendment from actually helping most citizens it applies to by the 6/3 Republican Majority.

Sonya Sotomayor notes:

“This Court’s order prevents thousands of otherwise eligible voters from participating in Florida’s primary election simply because they are poor,”

And

“And it allows the Court of Appeals for the Eleventh Circuit to disrupt Florida’s election process just days before the July 20 voter-registration deadline for the August primary, even though a preliminary injunction had been in place for nearly a year and a Federal District Court had found the State’s pay-to-vote scheme unconstitutional.”

This is another example of how the Conservative Judges interpret "due process" meaning "following the forms" and don't really care if either the spirit or the substance of the constitution is applied.

Reforms Needed to save our Federal Republic

In an article titled: Post-Roger Stone: Ten ideas for repairing Trump’s justice system By Jennifer Rubin, She writes:

“President Trump granting clemency to his crony Roger Stone, who served as the go-between for the Trump campaign and WikiLeaks, on practically the eve of Stone’s incarceration for multiple crimes attendant to his coverup on behalf of the president, is grotesquely corrupt but unsurprising.”

She recounts the latest Cassus Belli of Trump's perfidy

She notes that “Stone virtually confessed to a quid pro quo,” (To me he was boasting), telling Howard Fineman,

“He [Trump] knows I was under enormous pressure to turn on him. It would have eased my situation considerably. But I didn’t.”

I don't think anyone with integrity doesn't feel that this wasn't a high crime and a misdemeanor.Rubin writes:

“Silence for clemency. A separate system of justice for the president’s henchmen. This is the very definition of corruption.”

Former Candidate Romney put it baldly in a tweet:

"Unprecedented, historic corruption: an American president commutes the sentence of a person convicted by a jury of lying to shield that very president." Link to Tweet

She reports:

“By this action, President Trump abused the powers of his office in an apparent effort to reward Roger Stone for his refusal to cooperate with investigators examining the President’s own conduct,”

She also reports how House Judiciary Committee Chairman Jerrold Nadler (D-N.Y.) and Oversight and Reform Committee Chairwoman Carolyn B. Maloney (D-N.Y.) said in a written statement released Friday:

“No other president has exercised the clemency power for such a patently personal and self-serving purpose.”

Actually, her hero George Herbert Walker Bush, exercised his clemency and pardon powers in 1992 for just such a patently corrupt and self serving cause when he pardoned the perps in the Iran Contra scandal. But what counts with Republicans is what they are doing now, so I can forgive past crimes as long as folks have seen the light. This post is about her suggestions for fixing the problems. I'm endeavering to analyze the problem by critiquing her suggestions. Most of them are obvious or things that were taken out of the law due to misuse or to protect the wrong people. Any reforms made should be based on firm Constitutional Grounds. And if that is not adequate, it might take a Constitutional Amendment.

Clarify Impeachment

Nancy Pelosi was asked about President Trump's plan to commute Roger Stone's sentance and replied that she is looking into legislation that would forbid the President using his pardon power that way.  This is exactly the scenario I forsaw 2 years + ago.  
Simplistic legislation would probably fail a constitutional test. But there is a way to proceed that might succeed. There are two basis for this.
The house has "Sole Power of Impeachment"
That means not only does the house have the power to impeach executive & Judiciary members, but it has the power to write the rules of impeachment.  That means they can define the officers and offices involved, procedures, entry points and when and how a case should go to the Senate for trial.
Except In Cases of Impeachment
As I noted before, the President:
“shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment."
Thus the power to pardon is limited by impeachment.  So the House should be able to stop the President using his pardon power? But how.
Simply forbidding him won't work. He is not impeached at the moment because the case went to the Senate and they acquitted him.  SCOTUS would laugh such a law out the door.
Define the rules of impeachment
What congress needs to do is the opposite of what they have done in the past. The house needs to make impeachment part of its regular order, defining what can be impeached and setting up administrative bodies combining the powers of special prosecutors and Inspector Generals to police those infractions.
Open Impeachment
Essentially the house needs to have an open impeachment inquiry run by an inspector general under the supervision of a house Impeachment committee and define the terms under which individuals are part of an impeachment inquiry into the President and he cannot pardon them, or they are under the panels protection until it goes to trial in the Senate. It would function like a grand jury except legal products would become parts of censure resolutions & legislation.

Roberts Denies Powers of Impeachment

In our country some judicial powers are distributed. The executive has the power to bring charges and try cases in a court. Courts are saddled with juries, who represent actual democracy at work, since they are common people stepping up to judge cases.  The Judiciary is not supposed to make law, but through the power of interpretation often over-rides the legislature to make laws at odds with the will of the people. The separations of powers in the constitution are not absolute. Checks and balances require powers be distributed among the branches to put a check on tyranny and usurpation. 
Impeachment and oversight
The Constitution gave the house a judicial role when they gave the HOUSE has "sole power of impeachment." Roberts can't and won't do squat about executive corruption. Neither the executive nor the judiciary can be trusted to investigate themselves.  For that reason the impeachment process was distributed to the legislature.
Necessary and proper to impeachment
The House's sole power of impeachment requires inquiry powers beyond those with a purely legislative purpose.  Impeachment cannot be severed from oversight. Subpoenas are necessary & proper to discovering when impeachment is needed! Without the power to look at records and investigate issues, the impeachment power is denied.
Justice Roberts Denies Impeachment Power
Justice Roberts can't "give powers of oversight" to the house. The constitution gave the house those powers when they gave the house "sole power of impeachment." Nevertheless he sent the case back to the lower courts ordering them to meet 3 criteria!
One; The asserted legislative purpose is to oversee the President in a case where clear wrong doing has already been discovered, and determine whether or not impeachment is justified. Whether the House actually can send additional articles of impeachment to the Senate is immaterial. Whether they are actually impeaching the president yet, is also immaterial. Roberts should have denied certiori on this request because its not his business to rule on a House Constitutional prerogative.
Two; For the same reason, it is up to the house how broad a subpoena is. Impeachment is an administrative & political proceeding since the most Congress can do is remove and bar from office.  The house involves the courts when the executive disputes a subpoena. They are looking at evidence of misconduct.  They may pass laws to close the barn doors afterwards, but they have a natural right to the information.
Third; the courts need to remember the House has a legitimate legislative purpose in examining tax records of executives. This should be a moot point.
Fourth; the President has a duty to respond to subpoenas. The burden is on him complying.
There was no need to remand either case back to the courts. The House had already established a legislative purpose when they issued them, because this is part of their "sole power" of impeachment.

I've been listening to people talk about reforming the police and they all have good ideas. Some want to simply defund the police – even eliminate them – One twitter friend says [same as me].

"We need REAL police reform:

  • no outta town cops
  • no guns unless SWAT
  • no shooting suspects in the back
  • no military assault gear
  • no qualified immunity"

Misusing the Law

In 1932, thousands of WW1 vets camped with their families in Washington DC, petitioning the Federal Government to payout bonuses early so they could survive. The Hoover Admin sent in the Army with bayonets under McArthur to suppress & drive them out. This heartless & authoritarian action led to FDR winning election.
Trump Plots Takeover
Yesterday Trump attacked a peaceful protest. He has deliberately labeled peaceful protests riots and accused "antifa" of engaging in lawless rioting. It is obvious the rioting has largely been instigated by Trump allies, the so called "boogaloo Bois", proud boys, rw media, all have gotten in on the act. It was even alleged that "umbrellaman" who broke windows at a store to entice people to loot it, was a cop. This has been going on a long time. Back in the 60s Charlie Manson justified his murders claiming he was trying to start a race war. 
Tump thinks he can start a holocaust and use that to win reelection or dictatorial powers. I think it will fail.
Not to say it isn't possible.
That is not to say he won't try.  That little stunt of attacking peaceful protesters and then holding up a bible. Isn't designed to get majority support. He has disregarded the law, misappropriating funds for his border wall, and gotten away with it. So far just ignoring laws has worked for him. People are calling on congress to cut off funds. They have done it on other issues. He ignores them.
Who will stop him? The courts!
Will he succeed in avoiding and rigging elections? I hope not.
Its going to be a long hot summer.
Federal Powers to Intervene in States
To Enforce Federal Law Section 252 of Title 10 (previously section 332 of Title 10) delegates Congress’s power under the Constitution to call forth the militia279 to the President, authorizing him to determine that “unlawful obstructions, combinations, or assemblages, or rebellion against the authority of the United States make it impracticable to enforce the laws of the United States” and to use the Armed Forces as he considers necessary to enforce the law or to suppress the rebellion.”
Civil Rights Protection 
Section 253 of Title 10 (previously section 333 of Title 10) permits the President to use the Armed Forces to suppress any “insurrection, domestic violence, unlawful combination, or conspiracy” if law enforcement is hindered within a state, and local law enforcement is unable to protect individuals, or if the unlawful action “obstructs the execution of the laws of the United States or impedes the course of justice under those laws.”
This section was passed to implement the Fourteenth Amendment guarantee for equal protection. It does not require the request or even the permission of the governor of the affected state. It would be ironic if the President used a section of law intended to enforce civil rights, to suppress demonstrations in response to Federal tyranny.

TV Handmaids vs Trumpist & Taliban reality

There are real parallels between the Evangelicals depicted in the Handmaids tale, Trumpism and the Taliban.  Both the evangelical RW & Taliban are religious groups who reject the separation of Church and State, women's rights, & much of liberal democracy. But, while the Handmaids tale is fiction, the "Sons of Jacob" are plausible. The Taliban resemble them.  The story was written in the 60s. Updated for TV & the present it is even more terrifying.
Parallels to the Taliban
Parallels:
1. Commanders
The Talliban decentralized their movement in the face of arrests & imprisonments after losing electorally.  The treasonous revolutionaries who overthrew the USA &  created Gilead called themselves Commanders & their movement "Sons of Jacob" and used this structure to operate as both a movement and a terrorist army.  The Taliban have done the same.
The structure is ideal for a tneocratic autocracy, because a paramilitary organization with commanders can be both decentralized and under oligarchic control. They could employ almost unlimited resources of men and material and seemlessly take over government & business orgs & resources.
2. Oppression of women
Both Taliban and Gilead are all about Oppression of women. Gilead justified enslaving women on cherry picked biblical passages. The Taliban cherry pick Hadith & Koran.  The Taliban behave in a manner similar to the fictional rulers of Gilead. Destroy schools, Forbid literacy in children, force conservative dress, kill or enslave the rebellious. The world of Afghanistan resembles the fictional Gilead.
People forget that Iran and Afghanistan once had women doctors & were not that different from our country before revolutionaries took it over. People also forget that similar ideas are taught as dogma by dogmatic RW Christians & Catholics. In Gilead & Afghanistan reading is criminalized or punished.
Gilead and EMAD Trumpism
Thank God it didn't happen here! Yet.  But Trump draws his base [in Arabic alqaeda] from Fundamentalists with similar ideas to the Sons or Jacob.  It could happen here. And as the experts warn you, and as illustrated by both the "Handmaid's tale" and the Taliban, The rank and file may be true believers, but the leaders are Exploitive, Manipulative, Amoral & Dishonest [EMAD], or to use the clinical terms, at best Narcissistic, but with folks like Trump Psychotic, Sociopathic, ruthless & criminal people.  The taliban finances itself smuggling drugs & running extortion schemes.
What this means is that when people like Lawrence Tribe, tell you he will do anything he can to stay in power. And his wannabe Commanders talk up "There is no good Democrat but a Dead Democrat" there is good reason to be alarmed enough to make sure you get involved!!!
Our water supply is not yet polluted enough for handmaids. But the story is more plausible than it seems.

Why they execute Traitors

Been meditating on treason a lot.  The reason is historical example. Was reading about the English Civil War & then was watching the Tv version of the "Handmaid's tale", where they get into the story of how the USA was overthrown & Gilead born. And it struck me,
They execute traitors for a reason
Traitors are executed for two reasons.
1. Because those committing treason lead others and unless they are removed from the political equation, they tend to try again to overthrow the legitimate government.
2. Because if they succeed the legitimate government becomes a target of violent authority. The traitors have no compunction about branding the targets of their subversion as traitors & taking them out!
In "The Handmaid's tale", overnight it was once again illegal for gays to be married. They executed the prior government, changed the laws & made themselves the government. What they did was treason but because the USA didn't stop them. The old government either 
"T[oo]k a bow to the new constitution." [Rolling Stones]
Or they were executed.
Something similar happened in 17th century Britain. A number of people lost their heads. Charles I, then Olivar Cromwell ruled, died & he was decapitated posthumously by the returning Charles II.   On the other hand the "try again" principle got Henry VII the crown & Richard the 3rd a reputation as a cruel hunchback 200 years earlier.
Successful traitors write the Histories
If we let them live unsuccessful traitors try to rewrite history. Reading about efforts to revive the confederacy, repeal emancipation & rewrite the history of the confederacy remind me we should have executed the traitors who led the civil war. Their descendents are trying to rewrite the record.  Nikki Haley is still trying to defend the Confederate Battle flag & the racism and hate it stands for. 
Makes me wonder if I have to worry about successful treason.

Constituting a National Health Service

Governor Cuomo is calling for the reorganizing of our disjointed and dysfunctional health service into a National Health System.

This would necessarily include a National Health Service, public private partnerships, and a mix of reserve elements and active elements. A lot of people, including me, have seen the need for this for a long time, and so it is about time we begin taking the concept seriously.

Training and Disciplining "according to the discipline prescribed by Congress"

A national system has to be organized under either the current National Guard or in parallel to it. The easiest way would be to add a Reserve Health Guard Militia to the National Guard Schema. The existing Uniform Health Service would be expanded. And Reserve Health Guard Officers trained using existing medical schools in country, of Citizens, in return for service according to uniform standards. These officers would then be used for emergencies, shortages, to serve the Naval and Land forces, and in deprived locations where market based healthcare fails. Once they had completed a term of active service they would remain either reserve officers or Auxilliary Reserve officers but be free to go into private practice.

Public Private Relationships

Private doctors and healthcare companies would fall under the Reserve Health Service as Private Reserve Auxilliary "militia" members. Their entire companies could be called into service during emergencies. As a condition of their operating license, each company, institution, installation and provider would have to sign a contract with the National and State HealthCare Reserve and agree to meet readiness demands, in return for Federal compensation at a reasonable price when they are called into service or voluntarily serve emergency medical needs. They would have to meet federal and state standards.

Emergency Reserve Capabilities

Just in time supply would be supplemented by Emergency reserve capabilities. The scenario is that factories producing consumer coulds would have standbye protocols and equipment for rapid retooling to produce vital goods. Active duty Public Health Medical Logistics and forecasting Professionals would be able to create forcasts and requisition reserve supplies to meet those needs rapidly when called on. Congress should reconstitute the Pandemic Response institutions necessary for this.

Healthcare is National Security

The plans can be put into place and prepared in advance. Drills can be done. Food, Medicine, Health Care is as much a Security issue as weaponry and force of arms. Wars have been lost because armies were too sick to fight. Cuomo's recommendations are overdue. Universal healthcare does not mean we have to nationalize industry. It does mean that industry needs to remember they are part of a country and have duties as well as privileges. It does mean that profiteering and privateering, for private separate advantage, have no legitimate place in healthcare.

Election Judges! Election Courts!

Judging Elections

Elections are, in essence, a judicial process where common citizens acting as voters, judge the fitness of candidates and elected officers to serve them. They need the power to:

  1. Scrutinize candidates, officers and their promises
  2. Determine Fitness for Office
  3. Hold officials accountable for performance.
  4. Enforce transparency

Elections are where voters judge who is fit to lead them.

These are judicial functions, but also personnel decisions. Election courts don't decide whether or not a person is guilty of crimes, but whether they are fit for the office the people are electing him or her to.

Best Practices for Elections

Because elections are a judicial process they should be run with best practices that embody the best and most appropriate judicial principles.

Election Courts

The role of the election court is to ensure that the hiring authority, we the people, oversee the appointing of officers, Governors, Presidents, legislators. The people deserve to know what they are getting into.

Election courts have two missions;
Vetting, Shepherding elections and scrutinizing candidates
Scrutinizing Elected Officials at end of Term

Election Stakeholders

There are five sets of Stakeholders in an election.

  1. Voters are first.
  2. Parties, Factions, Movements and Activists.
  3. The Candidates, their factions and associations.
  4. Reporters and Investigators.
  5. Election Officials

All these stakeholders need to be represented in the process, which is why elections need to be run as if a court.

A judicial process requires judicial structures

The required scrutiny, vetting and accountability, requires the election be run as a court would be run. A proper election court must involve all the stakeholders who have an interest in the outcome of that election. It is up to the hiring authority, thru elections to judge candidates and officers on their qualifications and accomplishment. To do that requires that the court include representation of the candidates, their factions and parties, and that they are able to argue their case. The Beauty of using election courts is that the judge and juries involved can verify and validate the claims made by the candidates and their factions.

Election Judging Requires they behave like judges

We we need better election judging because currently "election judge" is often a misnomer. They need to behave like judges. That happens when they are prohibited from holding other office for the term of their office and beyond at least one term. It also happens when the local factions and candidates have a right to representation in the processes and events of the election. Representation of candidates in the court should be mandatory. The representatives should have a say in selecting the review panels that question candidates. The judge function should be limited and subject to agreement from stakeholders except on matters of law. Election Judges, through the the processes of the election court and the actual election, should have the power to enforce that these functions are done according to law but not to dictate outcomes or excert undue influence.

Election judges would have a prescribed, limited role to:
Oversee the scrutiny of candidates and officers.
Shepherd the process and ensure that the election is conducted fairly.
Select investigators and reporters to investigate and report on proceedings.
Select election panels to conduct scrutiny and debate, with input from the interested parties in the election.
Judge according to law and refer legal violations to an ordinary court.

Jury Panels Scrutiny

Every Candidate for a position of Trust, for elective or appointive office, should be vetted through an election court jury panel that includes the voters who stand to elect him or her. During Primaries the panels should be registered party members. During the general election, the pool of all registered voters. The purpose of these panels is to question candidates and investigators so that voters can judge the fitness for office of candidates and elected officers. The ultimate jury is the voters. The jury structures would serve the purposes of groups like the League of Women Voters or similar. They manage and develop information for scrutiny, vetting, debates. The panels would also rule on decisions made by election judges that are disagreed with by principles in the election (Candidates, factions, parties and their representatives).

Investigators and Reporters

The press is named and protected in the USA constitution for a reason. The reason is that elections require that ordinary people, who don't have time to be involved in elections full time, are kept informed. For that reason investigators and reporters need a license to investigate and report on candidates for office, and of elected officials seeking reelection and of the government offices they hold. This is a critical thing and needs to be resourced and funded by the public. The press should have a right to participate in elections in this role. They should be part of the election courts, questioning candidates and presenting information to voters.

Entry Points to Elections

When an election is scheduled, an election judge should stand up an election court for each phase of the election. Candidates should have to sign an agreement that their background be checked and scrutinized. The court can decide how much of the details of that information can be kept confidential, but the public should be informed of any past criminality or relevent scandal through the election jury panel.

Step One: Confidential Scrutiny

As an entry point for running for office each Candidate for office should agree to be investigated and scrutinized then and at the end of their term should they win the election. Candidates for reelection should have the performance of their previous term investigated, scrutinized and reviewed by the "Election Jury" panel under guidance of representation and testimony of investigators. If they want to run for reelection this should be mandatory. If they are stepping down, it should be done anyway.

We have a duty to look into candidate finances, associations, criminal and civil history, just as if they were applying for a clearance for a public trust job. Because they are. They should also agree to end of term scrutiny.

Step Two: Performance Review and report

This professional confidential review, should be done by a panel led by Election judge, with testimony by investigators and local reporters, some brought in by the Election judge, some by the interested Parties, including the candidate.

Those completing a term should have their performance reviewed and that review, with minority opinions represented entered into the public record after review by the panel. They work for "We the People."

Transparent Process

Interested parties and local press should have the right to petition to be part of this panel as witnesses and observers. They should be sworn to confidentiality for the duration of the hearings. Violating that oath should be cause for ejection and bar from further participation for a term. But once the work is done, it should be public record.

Inquisitory Powers

  • The Panel should have the power to subpoena, compel testimony, look at records, examine and cross examine investigators, witnesses, and claims based on evidence.

    All this would be under oath. Perjury would be referred to an ordinary court.

    Report Product

    The product of this panel would be a report, which would be required to be a factual document allowing minority and majority opinions based on facts alone. The subject would be limited to fitness for office and background.

    Disagreements on content would be referred to a jury of ordinary citizens using the voir dire process. Once all the panel, or jury, agree on the factual content of the report, it can be published and used in the election. Parts not agreed on in opinion, if they are factual, go to a minority report.

    End of Term Performance Reviews

    Election courts would be to use the same process of using experts and investigators for a review panel would look at elected officers at the end of their term, whether they run for reelection or not.

    Judicial Powers
    Election Courts should have subpoena and investigatory powers, and contempt powers, but no prosecutorial powers. They should have referral powers when a criminal action is discovered. The power to subpoena, take testimony, seek and seize documents and the power to put people under oath and refer them for perjury powers if they commit perjury, should be the limit of their power. In scrutinizing candidates and officers, they should have the power to examine financial, criminal, and background records. The agreement to submit this should be a condition of seeking office.

    Election managers should be an executive position supervised by election judges but separate from them.
    Judicial Election Judges
    Forbidden to run for office for the term of their Judgeship + 1 election.
    Oversee elections as judges, but have limited powers.
    Must use Election panels to moderate different phases of the election.
    Must use processes similar to a trial for the scrutiny power.
    Investigatory Vetting Scrutiny process
    Elections should employ reporters and investigators and empower them to dig into finances, backgrounds and qualifications in a manner nearly identical with clearance investigations. Indeed clearance investigations should use these courts.
    Professional Investigators and Journalists should be empowered to look into all relevant matters of candidates and officers reaching term. Their results should be presented to the court during the preliminary sessions and after validation in open session. When in Open Session, that information must be public as well as accurate. Preliminary results should be verified and validated before being presented in Open Session. And during preliminary Session, and open session, the parties involved should have representation and be able to cross examine witnesses.
    When there is a dispute between the parties, election juries should moderate those disputes. Selected on Jury trial principles but allowed to make some decisions on a majority vote. But not allowed to go beyond investigations and fact checking except to make referrals to a criminal court if illegal behavior discovered.
    Preliminary Sessions
    When the Candidate or officer is to be scrutinized, a panel should be assembled using a voire dire style process, of selecting ordinary citizens for the panel with 1/3 approved by the Candidate, 1/3 by an "Inquisitor" or by opposition candidate representative, whose job is to inquire as to the person under investigation, and 1/3 by the Judge. The panels should also include local press. Investigators gather documents, interview and record results and bring them back to the court. The information then is validated as much as possible and put into a preliminary report.
    Preliminary Review
    Once the Preliminary Report is assembled the Judge, inquisitor and representative review the preliminary report. Anything challenged gets investigated further. At some point the Judge shall present the Preliminary Review to the Jury. The Jury then shall work with the Judge, journalists, inquisitor and representation to validate the report. The Jury shall ask questions at this stage.
    Open Session
    The Final Fitness report shall be produced and reviewed in open session. Recording majority and minority views on the subjects reviewed, and the facts of the subject. This then becomes a record to go into election reporting, debates and election process
    Election debates
    Once the background checks and scrutiny are complete. The panels can then conduct debates to get candidates on the record as to proposed policies, goals, etc... These debates and sessions should also be public. and the reporters should be enabled to report on and summarize the positions.
    Free Press
    The Press, has a formal role in this process and may be subdivided up into jobs that are more than mere stenographers and archivists, but may involve reporters and investigators who's training overlaps that of police detectives. This process would ensure that the free press can do its actual job.

    Rationale

    A free press is necessary to the health of our society because it has a role in the recording, vetting and accounting of what the government does. Reducing reporting to a clerical role destroys its power to check officials. In elective courts journalists would be required to do sensitive investigations, not release sensitive information until the proper time.

    Elective Bar

    Journalists, investigators, jurors, Judges, all officers of the Election court should be sworn in as officers of the court. Their words should be considered under oath and penalty of perjury.

    Pirates and Democracy

    It is easy to get confused about the founders. They worked together to create the constitution, but North and South never really understood each other well. Philadelphia, Boston, and New York formed one axis. But the other axis stretched from Georgia to Virginia. They joined to fight the British. Without Unity, there would have been no United States and the States of the North would have gone from Colonies to neo-colonies and never escaped oppression. That unity was formed around economic, cultural and familial ties. But it also was formed around a willingness to embrace the concepts of Federalism, Democratic Republicanism, commonwealth and Democracy.

    Multiple Influences

    Some of those principles came from history and philosophers. But some of the sources were more intimate. Formal influences came from experience with the Dutch, the Swiss, Italian City States & Ancient Greece. They also came from enlightenment writers. But additional experience was informed by our own maritime history with piracy and privateering, conscription and militias. And our experience with neighbors like our own Indigineous.

    Federation and the Indigineous

    The Indigenous practiced forms of Democracy and Federation, that may have influenced the formation of our country. Politifact quotes Jon W. Parmenter's The Edge of The Woods: Iroquoia, 1534-1701:

    “It is highly probable that Anglo-Americans during the revolutionary era looked to Haudenosaunee governance as a model of a successful collective polity, and borrowed elements of Haudenosaunee practice in developing revolutionary American constitutional governments,”

    Politifact also cites a speech given in 1744, by Canassatego, an Onondaga chief, to representatives from Pennsylvania, Maryland and Virginia at a treaty conference in Lancaster, Pa.:

    “We heartily recommend Union and a good Agreement between you our Brethren,...Never disagree, but preserve a strict Friendship for one another, and thereby you, as well as we, will become the stronger. Our wise Forefathers established Union and Amity between the Five Nations; this has made us formidable; this has given us great Weight and Authority with our neighbouring Nations. We are a powerful Confederacy; and, by your observing the same Methods our wise Forefathers have taken, you will acquire fresh Strength and Power; therefore whatever befalls you, never fall out one with another.”

    However, it wasn't Democracy that made the Iroquois so powerful it was the concepts of Federation. The viral meme about the Iroquois conflates Democratic, Republican and Federation principles. The “E Pluribus Unum” concept is what the Iroquois were talking about and what Benjamin Franklin and others was referencing with his famous and somewhat brutal quote that if the Iroquois:

    “capable of forming a Scheme for such a Union," then the new nation of European origin should be able to as well.”

    So the idea of Democracy was not central to the indigineous influence on our founders. They were worried about what happens when States start out in disunity; they go to war. Federation is about avoiding and mitigating conflict.

    “The concept [of Federation is] based on peace and consensus rather than fighting."

    Pirates and Democracy

    I've found compelling evidence that Robert and Governeuer Morris were pirates. And Hamilton was not perfect either. But I've also found evidence they were nationalists, just as patriotic as the Southerners, abolitionists and wanted a unified nation not a confederacy. His work with Madison and Jefferson gave us a Strong nation that still survives.

    Had we been a loose confederacy, the Civil war would have started sooner and never ended. Fractured states are subject to external predation, colonialism and neo-colonialism.
    Hamilton wanted direct election of the President. He was able to stop the Congress from making the selection of the President by the State Governors or Congress, but the Electoral College was a compromise with Southern Politicians who did not want popular sovereignty.
    He also gave us a strong independent judiciary, which has saved us, even when it has been somewhat corrupt at times. As we can see right now, a Judiciary subject to executive and legislature, in the hands of a corrupt factional legislation and executive, would be the death knell of our Republic.
    The General Welfare clause has allowed our country to serve its people instead of its oligarchs.
    And Morris was the loudest, and pretty much the solo, voice against slavery at the Convention. Had he been listened to we might have avoided the Civil War.

    So these fellows, who in some ways were pirates, learned some of their appreciation for liberty from that. Robert Morris ran a pirate fleet during the Revolution. Like I said, pirates tended to be more democratic. Privateers, not so much. As I've noted before Thom Paine also learned something about democracy from crewing on Privateers. The ones that treated people fairly also operated more democratically -- and more like free pirate ships.

    Atlas Was Robbed

    Today is the last day of the year (I wrote this at the end of 2018). I started to watch "Atlas Shrugged" on a lark.  Folks often mistake young libertarians for liberals. Looking at NETFLICKS promotions this morning I realized, someone there is very so! They offer the Cheesy, updated, modern version of 'Atlas Shrugged.' I've tried to read it over and over again but it is a cheesy story with a cheesy plot & a misleading message. It is poorly written, unresearched. Worse the story is offensive to any understanding of reality, causality and not in a good way. This was like watching a Superman versus Bizarroman flick.

    The Trouble with Atlas Shrugged.

    The story starts with people demanding work. The headlines ask, "who cares about the inventories", while noting gasoline shortages. It shows images of black people striking for a Job. It has people saying "there is plenty of oil in the ground." It sounds like a Donald Trump campaign commercial. Trouble is, these are management decisions. She blames common folks for the responsibilities of her heros in management.

    False Causality

    The logical error that Ayn Rand committed was that of ascribing false causality to the dysfunction of reality. In the world of Atlas shrugged nobody works & that is the fault of,... drum roll ... workers. Management is somehow not responsible for their own decisions. She sees the pirates as heros while calling those workers looters.

    Actual History

    And the plot lines act like we still have competitive rail lines. In real life Passenger rail were looted & abandoned to airlines, bus lines & freight rail years ago, by the entrepeneurs. Those remaining  were given to the State via bankruptcy courts. Mexico is promoting jobs not nationalizing rail. She describes a world of Monopolists & pirates, & then makes them heros.

    Trump thinks he's John Galt

    None of this was new. But what I found fascinating was the Pirate Motiffe.  As depicted the line "who is John Galt" was a recruitment call to managers & elites to desert their posts & work for John Galt & join his war.

    The Book talks about allies of John Galt making war on US Shipping. It became obvious to me that she was advocating privateering. Anything goes capitalism is pirate capitalism, given a thin veneer of respectability by relabeling private warfare, private government of public assets and theft as legal privateering.

    It also occured to me that the owners strike was really a lock out. Especially after rereading the end. Scientists don't lie about the safety of "rearden metal", but con artists do. Years ago I wanted to write a parallel story where the safety testers were the heros & rearden metal full of plutonium & radioactive metals. In bizaaroland exec's & managers sabotaging their own business, are heros.

    Trump thinks he is John Galt. He doesn't need "gubbornment" so he can just "shut it down" to get his way. To his thinking it should be run for, by & of oligarchs. He loves the Russian model!

    Galts Gulch is Panama or Cyprus banks.  Treason is just business. After all it is our own fault we don't live in a libertarian paradise like Somalia.

    Ayn Rand was advocating thieves rules.

    Oversight including Impeachment

    Impeachment Process is Oversight Process

    I started this Post around June. I was listening to Representative Jerry Nadler, who heads the Judiciary Committee that would become an impeachment inquiry, and he was talking about "time constraints" and the difficulty of impeaching the President. It made me think, it really is difficult to impeach anyone. And that degrades the power of impeachment and attenuates its potential effectiveness. But:

    Is that a real problem or an example of bad process? In this era of gigantic government, where too much power is already delegated to the executive, aren't these matters of "bad constitution" rather than things we can't address? If so then they reflect antiquated process and that should be dealt with. In this post I include a few suggestions on how to modernize that process without a new constitutional amendment.
    What are the benefits if the House impeaches anyway?

    What Would Impeachment Accomplish Now?

    The benefits of the House impeaching the President anyway are:

    1. Doing so will Document Trump's crimes.
    2. This will provide input evidence for prosecutions once he's out of office.
    3. Doing this will hammer home to the general public the depth of Trump's perfidy.
    4. This will rebuke and may even shame the shameless Republicans in the House and Senate.
    5. This may help us defeat him electorally.

    For this reason, impeachment articles are worth doing, even with the knowledge that they'll get to the Senate and be ignored or tabled. It is my belief that each Article should focus on one set of infractions, document the criminality and abuse of power and why they are reason for impeachment. The reason for separate articles is that they should result in separate prosecutions, changes in law and impeachment/prosecution of co-conspirators. I personally like the "Drip Drip of investigations" idea. There are at least 8 or 9 articles needed, by my count, and each of them embraces several to hundreds of counts. For more on this see:

    Improving Scrutiny - Lessons from Trump and Kavanaugh Part I

    Without Scrutiny Any System Fails

    The Athenians were driven to put the vetting job into jury functions or ruling councils by experiences with demagogues or military rule. The difficulty of controlling officers was such that Athenian born philosophers came to be somewhat cynical about the prospects for survival of Democracy. But the lesson of history, including recent history, is that without formal vetting and accounting, monarchy, dictatorship, oligarchy and plutocracy all degenerate into tyranny, kakacracy (rule by the worst) and kleptocracy (rule by thieves); and resulting violence, inequity, & misery. There really is no good alternative to creating a system of scrutiny that has integrity.

    Vital to our Survival as a Nation and a World are:

    Separation of Powers
    Scrutiny involving:
    1. Free Press
    2. Legislative Oversight
    3. Executive Oversight
    4. Judicial Oversight/Jury Forms
    5. Scientific Scrutiny
    6. Establishing Measures
    7. Holding officers to account by those measures

    Privateering Vs the Commons

    Klepto Policies

    George Lakoff recommended using the word Privateering to describe klepto political policies like privatization. That term turns out to be extremely appropriate for understanding the modern confidence scheme movement that calls itself "conservative." They like to say they are for "Capitalism" and against "Socialism" but privateering is a bait and switch operation where fake capitalists acquire rents and usurp property they can use to extract loot. It is not what most people think of when they think of "free enterprise."

    The Sea Dog Tradition

    The term "privateer" ought to push buttons and make alarms go off for people who are paying attention. Our US mob always wants to be legal, so it buys politicians to legalize what would be criminal anywhere else. It turns out our own Mafia is the inheritors of the "Brotherhood of the Coast" and a tradition of piracy (Sea Dogs) that still infects our politics and business. it truly can be seen as an ideology that masques itself as "capitalism."

    An Ideology of Privateering

    This ideology embraces the following basic principles:

    FDR called these the principles of “economic royalism” & hinges on the following beliefs:

    The notions that:

    1. that all things, including people, are property that can be owned.
    2. that contracts, even coerced contracts, are sacred.
    3. that people, or their labor, can be owned by a person or corporation thru the power of contract.
    4. that a corporation can usurp personhood.
    5. that private government is superior to public government.
    6. that public government doesn't invest & can't have a positive role in economic or social progress.
    7. that profits come before any notions of public good or responsibility.

    Privateering As titles of nobility

    The Far Right calls a government that provides basic services "socialism", but they practice the privatization of anything that nature provides all of us and its placement into private hands. Land, minerals, water resources, all traditionally belong to “the commons” and yet we give them to private persons or privately owned companies to manage and extract wealth from. If someone by an accident of birth comes to own a part of nature's bounty, that is privilege not effort, labor or merit.

    Enclosing the Commons

    A privateering ideology is also an ideology of nobility. The constitution says that no titles of nobility should be granted. But it seems that granting property to self appointed nobility, that they can extract rents from, is fine.

    When what was previously run for the common good, is enclosed, turned out for profit. The term for that is "enclosing the commons." It is analogous to when land barons started stringing barbed wire across the plains and killing wandering cattlemen (free rangers). It is analogous to giving people "titles of nobility", except it usually is laundered through legal processes.

    Titles of Nobility

    We give titles of nobility to Owners of;

    • Sports Team Owners
    • Communications, energy and transport companies.
    • Monopolies, copyrights and patents.
    • Insurance, Health Care.

    Extracting Rents from monopoly

    And these owners extract profits from profiteering in medicines, health care products, and by overcharging everyone. They don't invest in new medicines or technologies so much as extract rents from existing products. When they do invest in new products they mark up the products so high very little of the investment is actual investment.

    A rentier doesn't care if the building, corporation or land he owns is kept in good order, or if people eat or survive. All they care about is extracting their rents.

    Criminal Contracts

    At the basis of oppression is the enforcement of criminal, unjust or oppressive contracts. US law has always treated criminal contracts as unenforceable. But when government is corrupt, it legalizes what would have been considered criminal in the past. Thus people are saddled with huge debt, with interest, for attending college; with criminal loans for their homes. With unconscionable rents. And have no recourse. This is privateering. It is legalized looting.

    Contracts as a Vehicle of Slavery

    Our country outlawed slavery, but it comes back to life through abusive contracts and abusive use of the law. Those who can't pay debts used to get put in debtor prisons. The system is trying to bring those back. The government outlawed the use of bankruptcy for dealing with education debts, and people are losing everything to debt for healthcare. Getting an education is a public good, not only for the student, but for society. Health care is a "non-refusable" public good where people will die if they can't get what they are unable to afford. Extracting profits and using debt to enslave people who need those services is engaging in modern slavery. Privateers used to have to grab and smuggle people from Africa. All they have to do now is print money through a bank and loan it to someone in our days.This is legal piracy, loan sharking and enslaving people.

    Usurping Personhood

    The Federal Government, thru, corrupt legislators and judges gave rights to corporations as artificial persons, in the 1880s, at the very same time they were taking it from the persons that the 13th, 14th and 15th amendments were intended to protect. Privateers, as economic royalists, love the Royal "we." The Corporation as a "person" asserts the rights to having a religious belief, to telling its employees what to do, and the right to enslave employees, take their labor and stiffing them on promised compensation. Many a CEO claims to speak for all his employees, they often claim to own their labor, innovations and enterprise. And they take a cut of everything.

    And thanks to corrupt SCOTUS, they claim a right to bribe and extort politicians into doing their bidding with unlimited corporate money. Monopolies and centralized power are putting pirates in charge of the country.

    Government and Investment

    A Convincing case has been made that without public investment, there would be little private wealth and it would be so poorly distributed that there would no longer be what we now think of as a middle class. The argument of con artists is that public investment doesn't improve society. This was a Reagan Era trope and is patently false. But it is also an excuse for privateering. The fact is that without public investment; no electrical grid, oil, canals, railroads, roads and highways. In fact no real civilization. The government is not allowed to treat its capital investment as capital due to accounting tricks perpetuated by pirates over a period of centuries. Even our money is privatized by legal pirates. Since the beginning of the country the absurdity of issuing private notes based on treasury notes has been obvious to critics. Yet, we depreciate direct treasury notes and let the Federal Reserve serve as a tongue louse on our financial system.

    Wage Slavery & Taxes

    In a paper published by Edward J. McCaffery titled "The Death of the Income Tax" he explains how the income tax became a wage tax & was suberted by generations of work by armies of lawyers, lobbyists & paid pseudo-schollars.

    When the income tax was first proposed, its target was to recoup some of the money created by the use of private money$ (currently Federal Reserve Notes & accounting money$ loaned into existence by banks), Corporate privilege, & Land Ownership.
    All of these income was derived from paper (notational) money and the interest on that money. This was unearned income "a.k.a. economic rent, passive income, land values"), from privileges granted by government to a self selected few & mostly earned jointly by the privateers & a crew of commoners from common property; but not shared with the crew, i.e. privateering.
    Anyway the income tax made sure financial capitalism generated profit for everyone while moderating the tyrannical impulses of the private separate interests who otherwise would have continued to build massive forces on the backs of labor. It's gradual demise reflects the efforts of those powerful interests & their avatars over a period of more than 70 years.
    It was never intended to be a tax on labor. Income from labor is earned, compensation for energy expended & little is net income after food, transport, housing & other taxes (economic rent is a form of private tax).  Taxing labor compensation violates basic principles of fairness and is thus unjust oppression, especially when it was never the original purpose of the income tax!     Trump's Five Principles of Autocratization

    Further he also practices the 5 principles of Autocratization that propaganda that others have used before him. Amazingly, Steve Schmidt, who I remember shilling for GW Bush years ago when GW was doing some of these things, recognized and had enough with #Trumpenfuhrer's methodology that even he is raising the alarm. His formulation of the 5 Principles of totalitarian propaganda, restated in my own words, is as follows:

    1. He uses Big Lie techniques to incite ferver in his base of fervent followers.
    2. branding scapegoats and rivals as enemies; affixing blame for complex problems to them and them alone.
    3. Further, he gaslights his followers by alleging conspiracies, hidden, nefarious and linked to those scapegoated populations
    4. He spreads a sense of victimization among them.
    5. He asserts the need to exert heretofore unprecedented power to protect his victim fans from those conspiracies and scapegoated populations.
